Mobilization Law: Disabled persons from Ukraine subject to repeated checks

Since mid-May, the new Law on Mobilization in Ukraine No. When 10449 comes into effect, some citizens who have acquired disabilities of groups I and II must again send medical and health specialist commissions. This study concerns a large number of conscripted men who received disabilities during the war years. All of them are forced to reassert their position.

Krekotnya stressed that men who received MSEK certificates from February 24, 2022 to May 16, 2024 will be verified. We are talking about type I and type II disability. The investigation will be conducted in cooperation with Ukrainian law enforcement authorities.

“According to the President, the Cabinet of Ministers in collaboration with law enforcement agencies will conduct a total review of the validity of the decisions of the MSEC regarding the first-time appointment of II and III disability groups to all males between the ages of 25 and 50 years who received the relevant group during the period from February 24, 2022 to May 16, 2024.”, The expert said.

At the same time, the total control of MSEK certificates does not “shine” for everyone. Some Ukrainians with disabilities will not be verified. First of all, we are talking about people who have no limbs or who have been disabled since childhood. They do not need to reaffirm their position. According to the lawyer, under the new law, those with the following categories of disabilities will not be subject to reconsideration:

  • Change of the disabled group: due to the consequences of diseases acquired during the defense of the motherland, injuries (wounds, wounds, lacerations);
  • Absence of a limb, arms (arms), legs (legs), one of a pair of limbs;
  • due to oncological disease;
  • as a result of intellectual disorders or mental disorders, cerebral palsy or other paralytic syndromes;
  • Childhood disability: Acquired from any cause.

The lawyer also stressed that no regulations have been approved at the moment on how repeat inspections will take place. No law or decision of the National Security Council has yet required persons with disabilities to self-examine.
